1. Introduction and Acceptance
Welcome to BudgetCal ("BudgetCal," "we," "us," or "our"). BudgetCal is a product of HeroLabs, a trade name of 17981341 Canada Inc., the company that owns and operates the Service. BudgetCal is a personal budgeting and financial calendar application operated at budgetcal.app. These Terms and Conditions ("Terms") govern your access to and use of the BudgetCal website, web application, and all related services (collectively, the "Service"). By creating an account, starting a free trial, or subscribing to BudgetCal, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Definitions
"Account" means a registered user account created to access the Service. "User Content" means any data you enter into BudgetCal, including transactions, categories, amounts, notes, attachments, and account details. "Subscription" means a paid monthly access plan (BudgetCal plan). "Free Trial" means the 30-day no-cost access period available to new users.
3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use BudgetCal. By using the Service, you represent that: (a) You are at least 18 years old; (b) You have the legal capacity to enter into a binding agreement; (c) You will use the Service only for lawful personal or household budgeting purposes; (d) Your use of the Service does not violate any applicable law or regulation in your jurisdiction. BudgetCal is not intended for children under 13. We do not knowingly collect personal information from anyone under 13. If we become aware that a person under 13 has created an account, we will terminate that account and delete associated data. Parents who believe their child has created an account should contact us at contact@budgetcal.app.
4. Account Registration
To use BudgetCal you must register by providing your name, email address, and a password. You agree to: - Provide accurate, current, and complete registration information; - Keep your password confidential and not share it with anyone; - Notify us immediately at contact@budgetcal.app if you suspect unauthorized access to your account; - Accept responsibility for all activity that occurs under your account credentials. Accounts are personal and may not be transferred to another person except through the household sharing feature available on the BudgetCal plan. We reserve the right to reject or terminate accounts that violate these Terms or that were created using false or misleading information.
5. Free Trial
New users receive a 30-day free trial with no credit card required. The trial provides full access to the Service at no charge. At the end of the trial period: - If you choose to subscribe, you will be prompted to enter payment information. - If you do not subscribe, your account is paused — a subscription prompt appears when you sign in, and you will not be able to access the app or your data until you subscribe. - Your data is fully preserved while your account is paused. Subscribe at any time to pick up exactly where you left off. - If your paused account remains inactive for more than 12 months, we may delete it and its data after sending at least 30 days' advance notice to your registered email address. We reserve the right to modify or discontinue the free trial offer for new sign-ups at any time. Changes to the trial do not affect trials already in progress.
6. Subscription Plans and Billing
BudgetCal offers one subscription plan: BudgetCal Plan — USD $9.99/month Includes: unlimited accounts, unlimited transactions, reports, recurring transactions, AI-powered receipt scanning, receipt/bill attachments, household sharing (up to 5 members), 60 months of future projections, 12-month cash flow forecast, and weekly spending digest emails. Prices are in US Dollars. Applicable taxes may be added based on your location and are your responsibility. Billing: Subscriptions are billed monthly. We do not offer annual billing. Your billing cycle begins on the date you first subscribe. Auto-Renewal: Your subscription renews automatically each month at the applicable price unless you cancel. We will send a renewal reminder email before each billing date. Payment Processing: Payments are processed by Stripe, Inc. BudgetCal does not store your full credit card number on our servers. By subscribing, you authorize us to charge your Stripe payment method each month until you cancel. Price Changes: We may change our subscription price from time to time. If we increase the price, we will notify you by email at least 30 days before the new price takes effect on your subscription. Your continued use of the Service after the new price takes effect constitutes acceptance of the new price. If you do not agree to a price change, you may cancel your subscription before your next billing date and no further charges will apply. Promotional Discounts: We may offer promotional pricing from time to time, including referral discounts and limited-time offers. All promotions are subject to the following: - We reserve the right to modify, suspend, or terminate any promotion at any time without prior notice. - Promotional rates and qualifying conditions may change at our sole discretion. - A promotion locked in as "permanent" or "forever" is permanent for as long as the promotion program remains active — we reserve the right to discontinue any promotion program with reasonable notice. - Promotional pricing does not limit our right to adjust the base subscription price.
7. Cancellation and Refunds
Cancellation: You may cancel your subscription at any time from your profile menu (avatar → Subscription → Manage Subscription), which opens our secure Stripe billing portal. Cancellation takes effect at the end of the current billing period. You retain full access until the period ends. We do not prorate refunds for mid-cycle cancellations. 30-Day Satisfaction Guarantee: If you are not satisfied with BudgetCal for any reason, you may request a full refund of your most recent monthly payment within 30 days of that charge. Submit refund requests to contact@budgetcal.app. This guarantee applies once per account. Extended Outages: If the Service is unavailable or materially non-functional for an extended period due to a fault on our side (not including scheduled maintenance), contact us at contact@budgetcal.app within 60 days of the affected month and we will make it right — typically with a prorated credit or refund for the affected period, determined in good faith based on the length and impact of the outage. Refund Processing: Approved refunds are processed within 10 business days to the original payment method. Scheduled Maintenance: We will notify you at least 24 hours in advance of scheduled maintenance expected to exceed 30 minutes.
8. Financial Data Disclaimer
BudgetCal is a personal budgeting tool designed to help you organize and visualize your finances. It is not a financial institution, financial advisor, bank, credit union, investment advisor, or any other regulated financial service. No Financial Advice: The balances, projections, totals, and calculations displayed in BudgetCal are based entirely on data you manually enter. They are for personal planning and organizational purposes only. Nothing in BudgetCal constitutes financial, investment, tax, accounting, or legal advice. No Accuracy Guarantee: While we strive for correct calculations, BudgetCal makes no warranty that displayed figures are accurate, complete, current, or error-free. Rounding, user entry errors, and system errors may affect displayed values. Software Limitations and Glitches: Like all software, BudgetCal may experience bugs, errors, glitches, or unexpected behavior that could result in incorrect calculations, missing data, display errors, or other inaccuracies in your budget information. We are not liable for any financial decisions, losses, or consequences arising from software errors, glitches, system outages, data corruption, or any other technical failure — regardless of whether the issue was caused by our software, third-party services, your device, or any other source. You should always independently verify important financial figures and not rely solely on BudgetCal for critical financial decisions. No Bank Access: BudgetCal cannot access your bank accounts, initiate transactions, transfer funds, or interact with any financial institution on your behalf. It is a manual entry planning tool only. Your Responsibility: You assume full responsibility for any financial decisions you make based on information displayed in BudgetCal. We strongly recommend consulting a qualified financial professional before making significant financial decisions.
9. Your Data and Content
Ownership: You own all User Content you enter into BudgetCal. We make no claim of intellectual property rights over your transaction data, categories, notes, or attachments. License to Operate: By using BudgetCal, you grant us a limited, non-exclusive, royalty-free license to store, process, and display your User Content solely for the purpose of providing and improving the Service to you. This license ends when you permanently delete your account. What We Do Not Do: - We do not sell your financial data to any third party. - We do not use your transaction data for advertising or ad targeting of any kind. - We do not share your financial data with data brokers, marketing companies, or analytics networks. - We do not analyze your spending patterns for any purpose beyond generating the in-app reports and insights you explicitly request. Third-Party Service Providers: We share data with the following providers solely to operate BudgetCal. Each has executed a data processing agreement with us: - Supabase — database storage and file storage - Stripe, Inc. — payment processing and billing - Resend — transactional emails (confirmations, billing receipts, weekly digests) - Anthropic PBC — AI receipt scanning on BudgetCal plan (images are processed and not retained by Anthropic) - Vercel, Inc. — hosting, performance monitoring, and aggregated analytics No other third parties have access to your financial data. Developer and Admin Access: Row Level Security is enforced at the database level, so no user can ever access another user's data. A restricted internal support dashboard, accessible only to named administrators, displays account-level information (name, email, subscription status, usage statistics, and account names/types — never your balances, transactions, notes, or attachments) solely for customer support, billing administration, and fraud or abuse investigation, as described in Section 9 of our Privacy Policy. Beyond that limited support access, we do not read, analyze, review, or monitor individual users' financial data for any reason. If an investigation ever requires deeper access to your data, we will contact you first and request your explicit permission.
10. Account Deletion and Data Retention
You may delete your account at any time from your profile menu (avatar → Account & Data → Delete My Account). You can also download a full export of your data (CSV) from the same menu before deleting. Upon account deletion: - All your transaction data, categories, attachments, and personal settings are permanently deleted from active systems within 7 days. - Backup copies are fully purged within 30 days. - We will send deletion confirmation notifications to our third-party processors within 7 days of your request. - Stripe billing records (payment history only, not your financial data) are retained as required by applicable financial regulations, typically 7 years. - Anonymized, non-identifiable aggregated usage statistics may be retained indefinitely for product improvement. If you delete your account during an active subscription, cancellation and deletion take effect simultaneously. No further charges will be made after deletion is confirmed.
11. Intellectual Property
All elements of BudgetCal — including the software, application design, user interface, trademarks, logos, icons, and content we create — are the intellectual property of 17981341 Canada Inc. (carrying on business as HeroLabs) and its licensors and are protected by Canadian, US, and international intellectual property law. These Terms do not grant you any rights to use our trademarks, logos, or brand assets without prior written permission. You may not: - Copy, modify, distribute, or sublicense the BudgetCal application or interface; - Reverse engineer, decompile, or attempt to extract the source code of the Service; - Create derivative works based on BudgetCal's software or design; - Use the BudgetCal name, logo, or brand in any way that suggests endorsement without our prior written permission.
12. Acceptable Use
You agree not to use BudgetCal to: - Violate any applicable local, provincial, national, or international law or regulation; - Attempt to gain unauthorized access to our systems, servers, or other users' accounts; - Use automated scripts, bots, crawlers, or scrapers to access the Service; - Upload, transmit, or store malicious code, malware, viruses, or harmful content; - Impersonate any person or entity or misrepresent your affiliation; - Share your account credentials with unauthorized persons (except household sharing as permitted by your plan); - Use the Service for any commercial purpose other than managing your own personal or household finances; - Interfere with or disrupt the integrity or performance of the Service. We reserve the right to suspend or terminate accounts that violate these rules without refund, at our sole discretion.
13. Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: (a) WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS; (b) WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES; (c) OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF: (I) THE TOTAL AMOUNT YOU PAID US IN THE 30 DAYS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (II) USD $20.00. These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if we have been advised of the possibility of such damages. Consumer Protection Exception: Nothing in this section limits any statutory rights you have as a consumer under the laws of your province, state, or country that cannot be waived by contract. If you are a consumer in the EU or UK, mandatory consumer protection rights under applicable law are not affected by these limitations.
14. Indemnification
You agree to defend, indemnify, and hold harmless BudgetCal and its officers, directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to: (a) Your use of or access to the Service in violation of these Terms; (b) Your violation of any applicable law, regulation, or third-party right; (c) Any false or inaccurate information you provide in connection with the Service; (d) Any User Content you submit that infringes a third party's intellectual property or other rights.
15. Regional Rights
Canada — PIPEDA and Quebec Law 25
If you are located in Canada, you have rights under the Personal Information Protection and Electronic Documents Act (PIPEDA) and, if in Quebec, under Law 25 (Act to modernize legislative provisions respecting the protection of personal information), including: - Right to access personal information we hold about you; - Right to correct inaccurate or incomplete information; - Right to withdraw consent for non-essential data processing; - Right to request deletion of your personal information; - Right to be informed of any privacy breach that poses a real risk of significant harm to you. Canada — Anti-Spam Legislation (CASL)
We comply with Canada's Anti-Spam Legislation (CASL). We will only send commercial electronic messages with your express or implied consent. Every commercial email includes a functioning unsubscribe link. Transactional emails (receipts, account notices) are exempt from consent requirements under CASL.
United States — California Consumer Privacy Act (CCPA/CPRA)
If you are a California resident, you have the following rights under the California Consumer Privacy Act as amended by the California Privacy Rights Act: - Right to know what personal information we collect, use, disclose, or sell; - Right to delete your personal information; - Right to correct inaccurate personal information; - Right to opt out of the sale or sharing of your personal information (we do not sell or share your data); - Right to limit use of sensitive personal information; - Right to non-discrimination for exercising your privacy rights. United States — Children's Privacy (COPPA)
BudgetCal is not directed at children under 13 years of age. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child under 13 has used or registered for BudgetCal, please contact us immediately at contact@budgetcal.app and we will delete that account and associated data promptly.
European Union and United Kingdom — GDPR / UK GDPR
If you are located in the European Economic Area or the United Kingdom, your data rights under the General Data Protection Regulation (GDPR) or UK GDPR include: - Right of access to your personal data (Article 15); - Right to rectification of inaccurate data (Article 16); - Right to erasure ("right to be forgotten") (Article 17); - Right to restriction of processing (Article 18); - Right to data portability (Article 20); - Right to object to processing (Article 21); - Right to lodge a complaint with your local supervisory authority. Our lawful basis for processing your data is the performance of our contract with you (Article 6(1)(b)) and, where applicable, your consent (Article 6(1)(a)). Australia — Privacy Act 1988
If you are located in Australia, you have rights under the Privacy Act 1988 (Cth) and the Australian Privacy Principles, including the right to access and correct your personal information. To exercise these rights: contact@budgetcal.app
16. Dispute Resolution
Good Faith Resolution: Before initiating any formal legal action, we ask that you contact us at contact@budgetcal.app to describe your concern. We will respond within 5 business days and make a genuine effort to resolve the issue informally. Governing Law: These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict-of-law principles. Jurisdiction: Subject to any mandatory consumer protection rights in your local jurisdiction, any legal action must be brought in the courts of Ontario, Canada. No Class Actions: To the extent permitted by applicable law, you agree to bring claims against BudgetCal only in your individual capacity and not as a plaintiff or class member in any class, collective, or representative action. This does not apply to EU or UK residents. EU/UK Exception: Nothing in this section limits your right as an EU or UK resident to bring claims before your local courts or to file a complaint with your national data protection authority.
17. Changes to These Terms
We may update these Terms from time to time to reflect changes in our service, legal requirements, or business practices. For material changes, we will: - Send a notification email to your registered address at least 14 days before the change takes effect; - Display a notice within the app; - Update the "Last Updated" date at the top of this page. Your continued use of BudgetCal after the effective date of any updated Terms constitutes your acceptance of the revised Terms. If you do not agree to the changes, you may cancel your subscription and delete your account before the effective date.
18. General Provisions
Severability: If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force. Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and BudgetCal regarding the Service and supersede all prior written or oral agreements and understandings relating to the subject matter. No Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Assignment: We may assign our rights and obligations under these Terms without your consent in connection with a merger, acquisition, or sale of assets. You may not assign your rights under these Terms without our prior written consent.
